Welcome to Forest & Forge Co. These Terms of Service apply when you visit our website, browse our products or place an order with us.

Forest & Forge Co. is an Australian small business based in the Southern Highlands, New South Wales. Our online store is powered by Shopify.

By using our website or purchasing from us, you agree to these Terms together with our Privacy Policy, Refund Policy and Shipping Policy.

1. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or protection that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian law.

Consumer guarantees apply automatically to goods and services supplied to consumers.

If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and the nature of the problem.

Any voluntary return, change-of-mind arrangement or other store policy offered by Forest & Forge Co. is in addition to your rights under the Australian Consumer Law.

2. Using Our Website

You agree to use our website only for lawful purposes.

You must not interfere with the operation or security of the website, attempt unauthorised access, introduce malicious software, misuse customer information, impersonate another person or infringe the rights of Forest & Forge Co. or any third party.

You are responsible for ensuring that the information you provide when placing an order, including your email address, billing information and delivery address, is accurate and complete.

3. Our Products

Forest & Forge Co. products are handcrafted in small batches.

Because many of our products are handmade and use natural materials, slight variations in colour, texture, shape, fragrance, finish or appearance may occur between batches or individual pieces.

These natural handmade variations are not, by themselves, considered faults where the product remains consistent with its description and applicable consumer guarantees.

We make reasonable efforts to photograph and describe products accurately. Lighting, screen settings and natural materials may affect how colours or finishes appear online.

If a product materially differs from its description or otherwise fails to meet an applicable consumer guarantee, your rights under Australian Consumer Law remain unaffected.

Product availability may change without notice due to the small-batch nature of our business.

4. Prices and Payment

Prices displayed on our Australian store are in Australian dollars unless otherwise stated.

The total payable amount, including applicable shipping charges, taxes and discounts, will be shown at checkout before you place your order.

Payment must be successfully authorised before an order can be processed.

Payments are processed using third-party payment services made available through Shopify and other payment providers.

If a genuine pricing or technical error affects an order, we will contact you as soon as reasonably possible.

We will not charge you a higher corrected price without your agreement.

If we cannot fulfil an order on the terms accepted, any amount already paid for the affected item will be refunded.

5. Orders

Placing an order is an offer to purchase the selected products at the price and on the terms displayed at checkout.

We may decline or cancel an order for legitimate reasons, including:

• an item becoming unavailable
• an obvious pricing or technical error
• suspected fraudulent activity
• an inability to deliver to the supplied address
• a legal restriction preventing us from completing the order

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

Please review your order carefully before submitting it.

If you need to request a change or cancellation, contact us promptly at hello@forestandforge.com.au.

We will assist where reasonably possible, although changes may not be possible once an order has been packed or dispatched.

6. Shipping and Delivery

Orders are packed and dispatched from the Southern Highlands, NSW.

Processing times, available delivery methods and current shipping charges are explained in our Shipping Policy and displayed at checkout where applicable.

Delivery timeframes are estimates and may be affected by postal or courier delays, weather, public holidays and other circumstances outside our reasonable control.

If an order is significantly delayed, lost or damaged in transit, please contact us so that we can investigate and assist.

Nothing in this section limits any rights or remedies available to you under the Australian Consumer Law.

Please check your delivery address carefully before submitting an order.

If you notice an error, contact us as soon as possible.

Where an incorrect address supplied by the customer results in a parcel needing to be redirected or resent, additional delivery costs may apply.

This does not apply where the delivery error was caused by Forest & Forge Co.

7. Returns, Refunds and Faulty Products

Our voluntary change-of-mind and return arrangements are explained in our Refund Policy.

Any exclusions, conditions or timeframes that apply to change-of-mind returns do not limit your rights where goods are faulty, unsafe, not of acceptable quality, not fit for a disclosed purpose, do not match their description or otherwise fail to meet an applicable consumer guarantee.

If you believe there is a problem with your purchase, contact us at hello@forestandforge.com.au with your order details and information about the issue.

We will assess the matter and provide an appropriate remedy where required.

8. Product Use and Safety

Products must be used for their intended purpose and in accordance with any care, burning, safety or usage instructions supplied.

Candles and other flame products must never be left unattended and should be kept away from children, pets, draughts and flammable materials.

For soaps and personal care products, please review the listed ingredients before use and discontinue use if irritation occurs.

Information provided about our personal care products is general product information and is not medical advice.

Forest & Forge Co. is not responsible for damage caused by misuse, failure to follow supplied safety or care instructions, unauthorised modification or circumstances unrelated to a product defect, except where responsibility cannot lawfully be excluded.

9. Website Information

We make reasonable efforts to keep product descriptions, pricing, availability and other website information accurate and current.

From time to time, information may contain an error or become outdated.

We may correct website information where necessary, subject to your rights under applicable law.

A correction to website information does not remove rights relating to an order that has already been accepted.

10. Intellectual Property

Unless otherwise stated, the Forest & Forge Co. name, branding, product photography, written content, graphics, designs and other original website content are owned by or licensed to Forest & Forge Co.

You may view and use our website for personal, non-commercial purposes.

You must not reproduce, republish, sell, commercially exploit or materially modify our original content without permission except where permitted by law.

11. Third-Party Services

Our website may use or link to third-party services including Shopify, payment providers, social media platforms and delivery services.

Those third parties may have their own terms and privacy practices.

We are not responsible for the content or operation of third-party websites that we do not control.

This does not limit any responsibility Forest & Forge Co. has under applicable law for the products or services we supply.

12. Privacy

Our collection, use and handling of personal information is explained in our Privacy Policy.

Shopify and other service providers may also process information where necessary to operate our online store, payment services and related systems.

13. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including rights and remedies arising under consumer guarantees that cannot be excluded under the Australian Consumer Law.

To the extent permitted by law, Forest & Forge Co. is not responsible for loss or damage caused by misuse of a product, failure to follow supplied instructions, unauthorised modification or events outside our reasonable control.

This does not exclude any right you may have to compensation for reasonably foreseeable loss or damage arising from a failure to comply with an applicable consumer guarantee.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, business operations or legal requirements.

Updated Terms will be published on this page with a revised date.

Changes apply from the date they are published unless otherwise required by law.

An order already accepted will not be retrospectively changed simply because these Terms are later updated.

15. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

16. Governing Law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.

Nothing in this section prevents a consumer from relying on any mandatory rights or protections available under Australian law.
